Private Construction Law

WITT | Wirtschaftsprüfer, Rechtsanwälte und Steuerberater handles construction projects of all sizes for both clients and contractors. We advise on both the contract design and during the construction phase. We have developed contract models for all construction contracts which are constantly adapted to current developments in legislation and jurisprudence. We develop tailor-made solutions hand in hand with our clients for the respective building project.


WITT | Wirtschaftsprüfer, Rechtsanwälte und Steuerberater represents our clients during the execution phase and negotiations with contract partners and third parties. The question of supplementary and disability management are in the foreground. If possible, we are looking for cooperative solutions without the involvement of courts, for example, arbitration agreements usually lead to fast, cost-effective and law conform results.


Real Estate Law

WITT | Wirtschaftsprüfer, Rechtsanwälte und Steuerberater supervises our clients from the purchase of the property through its planning and development until the administration or utilization of property.


We advise on land purchases and sales, on the completion of building and architectural contracts as well as the business field of commercial tenancy law.


Procurement Law

WITT | Wirtschaftsprüfer, Rechtsanwälte und Steuerberater supports both public and private clients in the process of designing procurement procedures according to VOB / A. We assist contractors to enforce their claims of order, in particular in the case of complaints concerning the award procedures. We advise in the case of unclear or misleading calls for tenders and represent our clients during reconnaissance talks and in the context of verification as well as damage procedures.


Architect and Engineer Law

The HOAI (Honorarordnung for Architekten und Ingeniure; Fee structure for architects and engineers) regulates the remuneration for architects and engineers only partially. The fees for special services and consultancy services can be freely agreed. The biggest problem is, however, that the HOAI - which is supposed to be only price regulations - regulates architects / engineers services extremely fragmented.


From the customers’ point of view, architect contracts should be focused on detailed regulations on the performance requirements, however, from the architects and engineers point of view, it is particularly important to determine which technical planning services are to be commissioned by the client as a prerequisite for their own services. Besides the remuneration and service issues, differentiated appointments are necessary in architect / engineer contracts.
